1. Application and Acceptance of the Terms
1.1 The ordering and sale of products via www.mosaicshops.com is offered to you by Wikashimi BV, company number 1025431144, with registered office at Linkhoutstraat 212, 3560 Lummen, Belgium. These general terms and conditions of sale are those of the seller.
1.2 “Buyer” means any natural or legal person who purchases one or more products via the webshop, as well as any visitor to the webshop.
1.3 These terms and conditions apply to all sales offered and concluded via the webshop www.mosaicshops.com or other agreements entered into via the webshop.
1.4 These terms apply to the exclusion of all other terms, in particular those applicable to sales or rentals in the seller’s physical store.
1.5 The seller operates exclusively in Europe. Consequently, the seller can only accept your order if the delivery address is located in Europe and is not a P.O. Box.
1.6 By placing an order via the webshop, the buyer declares to have read and accepted the terms and conditions of sale.
1.7 If, by judicial decision, one or more provisions of these terms are declared invalid, the remaining provisions of these terms and conditions of sale shall remain in full force and effect.
2. Formation of the Agreement
2.1 A sales agreement between the seller and the buyer is only concluded after the seller has explicitly accepted the (potential) buyer’s order and has informed the buyer thereof by means of a confirmation letter.
2.2 The moment the buyer receives the confirmation letter is the moment the agreement is concluded.
2.3 The seller reserves the right not to accept the order or, if applicable, to terminate the agreement without owing any compensation to the buyer, but subject to the refund of any amounts already paid.
This applies in particular if problems have arisen in the past with the person placing the order or their family members (in the case of natural persons), as well as in the case of problems with the specified delivery address or in the event of outstanding invoices.
3. Prices
3.1 Product prices are indicated in euros, including all taxes, excluding the buyer’s contribution to shipping costs.
3.2 The seller reserves the right to change prices at any time; however, products will be invoiced based on the rates in effect at the time the order is accepted.
3.3 The seller cannot be held liable for typographical errors in its offers that the buyer could reasonably be expected to recognize as such.
3.4 The price due is that stated in the confirmation letter.
3.5 The seller reserves the right to change the price after the agreement has been concluded, for example due to changes affecting shipping costs, new taxes, or typographical errors.
3.6 If the price is increased, the buyer has the right to terminate the agreement without cost and without the seller being obliged to pay any compensation.
3.7 Products remain the property of the seller until the price has been paid in full and final settlement has been received.
4. Payment
4.1 The following payment methods are available for ordering products via the webshop:

When using the above payment systems, the buyer must also comply with the applicable terms of the respective operators. The seller is not a party to the relationship between the buyer and the operator of the payment system.
4.2 The seller undertakes to make every effort to guarantee the security of the webshop user, but cannot in any case be held liable for any damage resulting from unsafe, incorrect, or negligent use of the webshop by the buyer, nor for any damage caused by third parties who misuse the website or payment system, except in the case of gross negligence or intent on the part of the seller, its representatives, or agents.
4.3 The seller complies with the rules regarding refunds of amounts paid by the consumer, in accordance with the Act of 6 April 2010 on Market Practices and Consumer Protection.
4.4 If a payment term has been agreed and in any case 30 days after delivery, the buyer shall automatically and without prior notice of default owe default interest of 1% per month and compensation of 10% with a minimum of €50.00.
5. Delivery
5.1 Products are shipped to the delivery address specified in the order (home address or other address).
5.2 The seller will make every effort to deliver the products as soon as possible, and the buyer will make every effort to receive the products during the delivery period.
5.3 If the ordered goods are not delivered within 30 days, an additional delivery period may be agreed upon between the buyer and the seller.
If no additional period is agreed, the agreement will be automatically terminated and the seller will refund any payments received within 30 days.
6. Right of Withdrawal
6.1 The right of withdrawal applies only to purchases via the webshop by natural or legal persons who acquire or use these products exclusively for non-professional purposes.
6.2 The Act of 6 April 2010 on Market Practices and Consumer Protection allows the consumer to notify the seller within 14 calendar days of receiving the product that they are withdrawing from the sale, without penalty and without giving a reason.
6.3 Goods must be returned within the same period, at the buyer’s expense, in their original, undamaged, and unopened packaging, without any adhesive tape, stickers, or writing on the box, together with all accessories, the user manual, and a copy of the invoice/delivery note, to:

Original packaging with writing or with transport or other stickers will not be accepted.
6.4 Incomplete, damaged, used, or soiled goods will not be taken back.
6.5 No later than 30 days after accepting the return, the seller will refund any amounts paid, excluding the direct costs of returning the goods.
6.6 If, in the case referred to in Article 6.5, the seller has not refunded the payment within 30 days after accepting the return, the seller shall automatically and without prior notice of default owe default interest of 1% per month and compensation of 10% with a minimum of €50.00.
6.7 The right of withdrawal does not apply to:
the delivery of goods made to the consumer’s specifications or clearly personalized
goods which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly
7. Privacy
7.1 Your personal data is stored by the seller and kept in your personal account in order to allow the seller to process your transaction correctly. Once stored, your future transactions will be processed more quickly.
7.2 The seller complies with the Belgian Act of 8 December 1992 on the processing of personal data, as amended by the Act of 11 December 1998, taking into account the European Directive of 24 October 1995.
This law stipulates that the person or company collecting data must have the consent of the person whose personal data is involved, that the data must be relevant, correct, and accurate, and that it must be collected for specific, clear, and lawful purposes. The person concerned must have access to the data and the right to amend it.
7.3 The seller undertakes not to pass on any personal information to other organizations, whether for commercial or non-commercial purposes.
8. Applicable Law
8.1 The sale to which these terms and conditions relate is subject to Belgian law.
8.2 Only the courts of the judicial district of Hasselt shall have jurisdiction.
